Digital Wallet Terms of Use

The following terms and conditions (“Terms”) govern your use of third party digital wallets (each a “Wallet”) in relation to any eligible credit card issued by Wealthsimple Payments Inc. (each a "Card") in a Wallet.  The words “you” and “your” mean a customer of Wealthsimple Payments Inc. whose name is on the Card or anyone that is allowed to use a mobile device with a Wallet enabled to use the Card (“Device”). “We”, “us”, “our” and “Wealthsimple” mean, as applicable, Wealthsimple Payments Inc. and its affiliates. 

PLEASE READ THESE TERMS CAREFULLY. These Terms are a legal agreement between you and Wealthsimple. If you add, activate or use a Card in a Wallet, it means that you accept and agree to these Terms. 

  1. OTHER TERMS AND CONDITIONS STILL APPLY. The Card is governed by the applicable account agreement(s) between you and Wealthsimple (“Account Agreements”). Nothing in these Terms changes your responsibilities under the Account Agreements. 

  2. THIRD PARTY AGREEMENTS. You understand that your use of a Wallet will also be subject to agreements or terms of use with the relevant Wallet provider ("Wallet Provider") and other third parties (such as your wireless carrier and other merchants, websites and services integrated into a Wallet). 

  3. ADDING A CARD TO A WALLET. If you want to add a Card to a Wallet, you must follow the procedures adopted by the Wallet Provider and any further procedures we adopt. You may not add a Card to a Wallet if: (i) the Card is not eligible to be added to the Wallet; (ii) the account associated with your Card is not in good standing; (iii) we cannot authenticate the Card or otherwise suspect that there may be fraud associated with the Card or an associated account; or (iv) your Card or access to a Wallet has been suspended or terminated. 

  4. YOU ARE RESPONSIBLE FOR TRANSACTIONS PERFORMED THROUGH A WALLET. A Wallet may allow you and anyone else who has access to your Device to make purchases using the Card. When you use your Card through a Wallet to transact, it is the same as if you swiped, inserted, waved, tapped or otherwise used your physical Card to transact. Wallet transactions will be added to your credit card statement and your transaction history. You are responsible for transactions carried out through a Wallet and any associated interest charges and fees.

  5. APPLICABLE FEES. We do not charge you fees for adding a Card to, or using, a Wallet. Please review the Account Agreements for any fees, interest, or other charges that apply to your Card. The Wallet Provider or other third parties may charge you fees when you use your Device or a Wallet to transact. Wealthsimple is not responsible for any such fees. 

  6. WEALTHSIMPLE IS NOT RESPONSIBLE FOR OPERATION OF A WALLET. Wealthsimple is not the provider of a Wallet and is not responsible for its performance or non-performance. A Wallet may not be accepted at all places where your Card is accepted. Wealthsimple is not responsible for your inability to use a Wallet for any transaction or for any other failure of a Wallet. We are also not responsible for any loss, injury or inconvenience you suffer as a result of your use or attempted use of a Wallet. We are only responsible for the Card as set out in the applicable Account Agreements. If you have questions or concerns about the operation of a Wallet, please contact the Wallet Provider.  

  7. SAFEGUARDING YOUR ACCOUNT. It is your responsibility to keep your Card and your Wallet secure and to notify us of any suspected errors or fraud. In addition to the safeguarding requirements outlined in the Account Agreements, you agree to protect and keep confidential all information required for you to access your Device and a Wallet, including, without limitation, your username, user ID, passwords, passcodes and any other information (including biometric information) and credentials required for you to make purchases with your Card using a Wallet (“Credentials”). You are responsible for protecting your Card and Credentials. If you do not take reasonable steps to prevent misuse of your Card or access to a Wallet, you may be responsible for any unauthorized use of your Card through a Wallet. If you share your Credentials or Device with others, or allow others to enroll their fingerprint, face ID or passcode on your Device, they may be able to make purchases with your Card through a Wallet. 

  8. Think your Device, Card, Credit Account, PIN and/or other Password is or could be compromised, lost or stolen? You must notify us immediately at 1-855-255-9038 and, if possible, block your Card through your Wealthsimple app. You are responsible for all transactions made using your Card, except as specifically described in the Account Agreements or as otherwise provided by law.

  9. SECURITY OF A WALLET. The security of information provided to, or stored by, the Wallet Provider or any other third parties in connection with a Wallet is outside of Wealthsimple’s control. We are not responsible for any security breach affecting any information collected, stored or sent in connection with a Wallet.

  10. DISPOSING OF YOUR DEVICE. You must remove the Card from all Wallets before you dispose of or temporarily transfer control, of the Device (for example, for repairs), otherwise the Card may be available to the person who obtains your Device and you will be responsible for any transactions, and any associated interest charges and fees completed with your Device.

  11. CANCELLATION AND/OR SUSPENSION. Wealthsimple may change the cards eligible for use in a Wallet or stop participating in any Wallet at any time.  We may, at any time, block, suspend or cancel your use of the Card and block you from adding an otherwise eligible Card to a Wallet. We may take these actions at any time, without telling you first, and for any reason, including if you fail to comply with these Terms or your Account Agreements. You may remove a Card from a Wallet by following the Wallet Provider's procedures for removal.

  12. PRIVACY. The collection, use and disclosure of your personal information in connection with your use of the Card or Credit Account is subject to our Privacy Policy, available at wealthsimple.com/en-ca/legal/privacy, which is incorporated into this Agreement by reference. You hereby agree that we may exchange your personal information with the Wallet Provider for the purposes of identity verification, security and fraud prevention, facilitating a purchase or transaction, internal analytics and reporting, assisting the Wallet Provider in improving its products, providing you with services in connection with your use of a Wallet, such as information about your transactions and history, or as otherwise permitted or required by law. The Wallet Provider may handle your information differently, so please review the Wallet Provider's privacy policy and any other agreements that apply to their Wallet. We are not responsible for any loss, injury or other harm you suffer in connection with the Wallet Provider’s use of your information.

  13. CHANGES TO THESE TERMS. We may change all or part of these terms at any time and without notice, unless prohibited by law. Your continued use of the Card in the Wallet will be taken as your acknowledgement and agreement to be bound by any changes to these Terms. The date of the most recent change to the terms will be shown at the top of these Terms and you agree to check these Terms from time to time.

  14. LANGUAGE. It is the express wish of the parties that this Agreement and all documents, notices and other communications relating to the operation of your Account be in English.
